Agreement to Terms
These Terms of Service ("Terms") govern your use of Saleio's website and lead generation services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Description of Services
Saleio provides AI-powered lead generation services for home improvement contractors. Our services include generating, qualifying, verifying, and delivering exclusive leads for trades including roofing, siding, windows, bathrooms, and kitchens. Leads are delivered directly to contractor clients via API or other agreed-upon delivery methods.
Contractor Client Terms
As a contractor client of Saleio, you agree to the following:
- Exclusive use: Leads delivered to you are for your exclusive use only. You may not resell, transfer, or share leads with any third party.
- Timely follow-up: You agree to contact leads promptly upon delivery. Saleio is not responsible for your close rate or conversion performance.
- TCPA compliance: You are solely responsible for complying with the Telephone Consumer Protection Act (TCPA) and all applicable federal, state, and local laws governing consumer contact, including but not limited to calling and texting practices.
- Do Not Call compliance: You are responsible for scrubbing leads against the National Do Not Call Registry as required by law. Note that homeowners who submitted a lead form have provided consent to be contacted regarding their inquiry.
- Professional conduct: You agree to conduct yourself professionally in all interactions with leads and to honor any promises made in our advertising on your behalf, including free inspections or estimates.
- Licensing: You represent and warrant that you hold all required licenses and insurance to perform the services you offer in your service area.
- Accurate information: You agree to provide accurate business information and to promptly notify Saleio of any changes to your service area, trade, or business status.
Lead Validity and Refund Policy
A lead is considered valid and billable when it meets all of the following criteria:
- The lead provided a valid, working phone number
- The lead confirmed they are a homeowner or authorized decision maker
- The lead expressed genuine interest in the service for which they were contacted
- The lead is located within your agreed service area
Invalid leads — defined as leads with incorrect contact information, confirmed non-homeowners, or leads outside your service area — may be credited upon written request within 72 hours of delivery. Leads that do not convert to appointments or jobs are not eligible for refunds, as close rates are dependent on your sales process and follow-up practices.
Payment Terms
Payment terms are established in your individual service agreement with Saleio. All fees are due according to the schedule outlined in your agreement. Late payments may result in suspension of lead delivery. All fees are non-refundable except as explicitly stated in our refund policy above.
Testing Phase
New campaigns begin with a 100-lead testing phase during which our AI system optimizes targeting for your specific market. Lead quality during the testing phase may be lower than in subsequent campaigns, and this is reflected in the testing phase pricing. Saleio makes no guarantee of specific close rates or revenue during or after the testing phase.
Intellectual Property
All content on the Saleio website, including text, graphics, logos, and software, is the property of Saleio and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.
Disclaimers and Limitation of Liability
Saleio provides lead generation services on an "as is" basis. We make no warranties, express or implied, regarding the quality, accuracy, or completeness of leads, or that our services will meet your specific business requirements.
Saleio's liability to you for any claims arising from these Terms or our services shall not exceed the total fees paid by you to Saleio in the three months preceding the claim. In no event shall Saleio be liable for indirect, incidental, special, or consequential damages.
Indemnification
You agree to indemnify, defend, and hold harmless Saleio and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of our services, your violation of these Terms, or your violation of any applicable laws, including TCPA violations in your communications with leads.
Termination
Either party may terminate the service agreement with 30 days written notice. Saleio reserves the right to immediately suspend or terminate services if you violate these Terms, engage in fraudulent activity, or fail to make required payments. Upon termination, all outstanding fees become immediately due and payable.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify active clients of material changes by email. Your continued use of our services after notification of changes constitutes your acceptance of the updated Terms.
